Abstract

Die Entwicklung eines „globalen Rechts“ jenseits des Staates stellt die Referenzen und Grenzbegriffe in Frage, mit deren Hilfe bisher eine Art „Einheit der Rechtsordnung“ konstruiert worden ist. Dies ist auch für die Rechtstheorie eine Herausforderung. Gibt es überhaupt ein „Weltrecht“, das sich nicht aus den bisher anerkannten „Rechtsquellen“ speist? Tritt die Leistung des Rechts hinter die Ordnungsleistung anderer Systeme zurück? Lässt sich gar die Behauptung aufstellen, die Fragmentierung des globalen Rechts sei ein Produkt der „Eigenrationalitätsmaximierung aus erfolgreicher Funktionsspezifizierung und Risikosteigerung aus erfolgreicher Risikoabsorption“ durch einzelne Systeme1, insbesondere des Wirtschaftssystems, zu Lasten anderer und damit auch des Rechtssystems? Wie lässt sich ein nicht auf bestimmte „Quellen“ rückführbares Recht von anderen sozialen Normen unterscheiden, die in großer Zahl in globalen Netzwerken generiert werden? Wie lassen sich Übergangsphänomene beschreiben?

The development of a “global law” extending beyond the sphere of the state calls into question the references and limit‐concepts [Grenzbegriffe] which have previously been used to construct a kind of “unity of the legal system”. A challenge also arises as far as legal theory is concerned. Does there in fact exist any “world law” whose sources are not the previously acknowledged “sources of the law”? Is the law less effective than other systems in establishing governance? Is it even possible to state that the fragmentation of global law is a product of the “maximisation of inherent rationality derived from successful function specification and risk increase derived from successful risk absorption” by individual systems1, in particular the economic system, to the detriment of other systems including the legal system? How can a law which cannot be traced back to particular “sources” be distinguished from other social norms which are being generated in large numbers in global networks? How can transitional phenomena be described?
